A former driving instructor who killed five members of one family after causing an accident while overtaking their car will not spend time in jail after receiving a suspended sentence.
Ronald Frederick Jaray, 68, had pleaded guilty to negligent driving occasioning death in relation to the crash on Picton Road at Wilton on December 6.
Picton Local Court heard today that Jaray was once a driving instructor. This made the tragic accident "even more inexplicable", according to the local court magistrate who gave him a 12-month suspended jail sentence and suspended his licence for two years.
Wali Qsim, 40, his wife Shaifa Reza-e, 23, and their three-month old son Erfan were killed when their Toyota Camry spun out of control and into the path of a truck. Also killed were sisters Kobra and Habibah Reza-e.
During sentencing at Picton Local Court today, Magistrate Robert Walker described the incident as a "catastrophic and tragic accident".
He said while Jaray's actions in overtaking the family's car showed little regard for safety, it was not an uncommon mistake made by drivers.
"The grim reality is that if there had been in place a cement barrier separating oncoming traffic ... this incident may have resulted in a minor collision at a much slower speed with limited damage," he said.
